Lawyer Reveals How Tom Brady & Giseles Prenup Affects Their Divorce

After over a decade of marriage, Tom Brady and Gisele Bundchen are reportedly getting a divorce. Given that they’re both worth hundreds of millions of dollars each, the news has many wondering whether the division of assets will make the divorce complicated.

Leslie Barbara, attorney working for Divorce and Family Law Group at Davidoff Hutcher & Citron, spoke to Distractify about the couple’s divorce. Though she’s not representing Tom or Gisele, Leslie gave her predictions about how their alleged prenup will impact the divorce.

She explained that any assets the couple had before marriage is likely protected by the prenup.

"The agreement, in likelihood, would protect all the assets that each party came into the marriage with, including any appreciation or transmutation of those assets,” Leslie said.

But it’s possible that assets gained after tying the knot may be considered marital property and could be subject to division.

Gisele is the big earner in the relationship, with a reported net worth of $400 million (and an annual income of $40 million). For his part, Tom is worth an estimated $250 million ($30 million/year).

Reports say that Tom and Gisele’s divorce was sparked by his return to the NFL. He announced his retirement in February, only to reveal he was un-retiring weeks later to play another season with the Tampa Bay Buccaneers.

But Tom also revealed he signed a ground-breaking $375 million deal with Fox Sports to become the network’s lead NFL analyst, greatly increasing the athlete’s overall worth.

Gisele was apparently upset with Tom’s decision to return to the NFL, as she wanted him to spend more time with family. But she’s also reportedly pushed to renegotiate their prenup considering his multi-million contract with Fox Sports.

Gisele is rich in her own right ,” an insider said June. “But her friends are telling her she’d be nuts not to revise their prenup and she’s likely to listen to them.”

Tom and Gisele’s divorce isn’t only likely to be complicated due to their assets, but also their two children, Benjamin, 12, and Vivian, 9. Leslie told Distractify that most prenups don’t address custody or child support.

She explained, "With regard to any decisions involving child support, these determinations are made by looking at the needs of the children, with the goal of maintaining the lifestyle to which they are already accustomed.”

What is unlikely, though, is alimony consider how much Tom and Gisele are individually worth. "Alimony is typically to help people get back on their feet, or to maintain a standard of living, so it’s not applicable here given the vast amount of assets that are being divided,” the lawyer explained.
